Terms of Service

1. Acceptance of Terms

By accessing or using the Find or Be Found mobile application and related services (collectively, the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not access or use the Service.

These Terms constitute a legally binding agreement between you and Dani Blade LLC, operating as Find or Be Found ("we," "us," or "our"). Your continued use of the Service following the posting of any changes to these Terms constitutes acceptance of those changes.

2. Eligibility

To use the Service, you must meet the following requirements:

• You must be at least 18 years of age. By creating an account, you represent and warrant that you are at least 18 years old.
• You must be legally capable of entering into a binding contract.
• You must not be prohibited from using the Service under applicable law.
• You must not have been previously removed or banned from the Service.

Find or Be Found is a faith-based dating community designed for individuals who share Christian values and are seeking meaningful, faith-aligned relationships. While users of all backgrounds are welcome, the Service is designed with Christian principles at its core.

3. Account Registration & Profile Accuracy

To access certain features of the Service, you must create an account. When registering, you agree to:

• Provide accurate, current, and complete information during registration and in your profile.
• Maintain and promptly update your account information to keep it accurate and complete.
• Maintain the security of your account credentials and not share your password with any third party.
• Accept responsibility for all activities that occur under your account.
• Immediately notify us of any unauthorized use of your account.

Profile Content

Your profile is how other users discover you. You agree that all information in your profile, including photos, biographical details, and faith background, is truthful and represents you accurately. Misrepresentation of your identity, age, faith background, or relationship intentions may result in immediate account termination.

Photo Verification

We may require photo verification to confirm your identity. Verified profiles receive a verification badge. Attempting to circumvent the verification process or using someone else's photos is a violation of these Terms.

4. Membership & Pricing

Legacy Founding Member Rate

Early supporters may access the Legacy Founding Member rate of $9.99 per month, representing a 67% discount from the regular rate of $29.99 per month. This rate is locked in for as long as your membership remains active and in good standing. Legacy spots are limited and available on a first-come, first-served basis.

Regular Membership

The standard membership rate is $29.99 per month. Pricing is subject to change with reasonable notice to existing members.

Pay-When-Matched Model

Find or Be Found operates on a pay-when-matched model. Certain core features are accessible without payment, while premium features and unlimited matching require an active subscription.

Billing & Cancellation

• Subscriptions are billed on a recurring monthly basis through the applicable app store (Apple App Store or Google Play Store).
• You may cancel your subscription at any time through your app store account settings.
• Cancellation takes effect at the end of the current billing period. No partial refunds are issued for unused portions of a billing cycle.
• Legacy Founding Member rates are forfeited upon cancellation and cannot be reinstated.

5. User Conduct & Community Standards

Find or Be Found is built on a foundation of Christian values, mutual respect, and genuine connection. All users are expected to uphold these standards.

You agree to:

• Treat all members with dignity, kindness, and respect.
• Engage in honest and authentic interactions.
• Respect others' boundaries, beliefs, and personal choices.
• Report any behavior that violates these Terms or compromises the safety of the community.

You agree NOT to:

• Harass, bully, intimidate, or threaten any other user.
• Post or transmit any content that is hateful, discriminatory, violent, sexually explicit, or otherwise offensive.
• Use the Service for any commercial purpose, solicitation, or advertising without our prior written consent.
• Impersonate any person or entity, or falsely state or misrepresent your affiliation with a person or entity.
• Use automated systems, bots, or scripts to access the Service.
• Attempt to gain unauthorized access to any portion of the Service or any other systems or networks connected to the Service.
• Engage in any activity that could damage, disable, or impair the Service.
• Stalk, follow, or contact any user who has indicated they do not wish to be contacted.
• Solicit money or financial information from other users.
• Use the Service for any illegal purpose.

Zero Tolerance: Child Sexual Abuse and Exploitation (CSAE)

Find or Be Found has a strict zero-tolerance policy for Child Sexual Abuse and Exploitation (CSAE) in any form. The following are absolutely prohibited and will result in immediate permanent account termination and reporting to law enforcement:

• Any content that sexualizes minors, including AI-generated or digitally altered imagery.
• Grooming behavior or any attempt to establish inappropriate contact with a minor.
• Sharing, soliciting, or distributing Child Sexual Abuse Material (CSAM) or any exploitative content involving minors.
• Any communication that seeks to engage a minor in sexual activity or an inappropriate relationship.
• Sextortion or any form of coercion targeting minors.
• Trafficking of minors in any form.

When we obtain actual knowledge of CSAM on our platform, we take immediate action to remove the content, terminate the responsible account, and report the incident to the National Center for Missing and Exploited Children (NCMEC) via their CyberTipline at report.cybertip.org, as required by 18 U.S.C. § 2258A.

6. Content Guidelines

Photos

• All photos must be of you and must be recent (taken within the last 2 years).
• Photos must not contain nudity, sexually suggestive content, or graphic violence.
• Group photos should clearly identify which person is you.
• Photos must not include minors unless they are your children and you include appropriate context.
• Photos containing watermarks, overlays, or excessive filters may be removed.

Biographical Information

• Bios should be authentic and reflective of who you are.
• Do not include contact information (phone numbers, social media handles, or email addresses) in your bio.
• Bios must not contain offensive language, hate speech, or discriminatory content.

Messages

• Messages must be respectful and appropriate.
• Unsolicited explicit or sexual messages are strictly prohibited.
• Spam, chain messages, and commercial solicitations are not allowed.
• Threats of any kind will result in immediate account termination and may be reported to law enforcement.

Content Ownership

You retain ownership of the content you post on the Service. By posting content, you grant us a non-exclusive, worldwide, royalty-free license to use, display, reproduce, and distribute your content solely in connection with operating and providing the Service.

7. AI Features & Limitations

Grace: AI Interview

Find or Be Found features Grace, an AI-powered interview system designed to help understand your personality, values, and relationship preferences. By participating in the Grace interview, you acknowledge that:

• Grace is an artificial intelligence tool and not a human counselor, therapist, or matchmaker.
• Responses provided during the interview are used to enhance your profile and improve match quality.
• AI-generated insights and assessments are algorithmic in nature and may not perfectly capture the nuances of your personality or preferences.
• You may update or redo your interview at any time.

Divine Match Scoring

Our matching algorithm generates compatibility scores based on information from your profile, interview responses, and stated preferences. You acknowledge that:

• Match scores are estimates of compatibility and are not guarantees of relationship success.
• The algorithm considers multiple factors including faith alignment, values, personality traits, and lifestyle preferences.
• We continuously refine our matching algorithm, and scores may change over time.
• You should exercise your own judgment when deciding to connect with other users, regardless of match scores.

8. Communication Features

Chat Messaging

The Service provides in-app messaging for matched users. Messages are intended for the purpose of getting to know potential matches. We reserve the right to monitor messages for compliance with these Terms and to protect user safety.

Video & Audio Calls

Find or Be Found offers video and audio calling features to facilitate deeper connections. By using these features, you agree to:

• Conduct yourself respectfully during all calls.
• Not record, screenshot, or capture calls without the other party's explicit consent.
• Not engage in any inappropriate, harassing, or illegal behavior during calls.
• Understand that call quality depends on your internet connection and device capabilities.

Ice Breakers

The Service may provide conversation starter suggestions ("Ice Breakers") to help initiate meaningful conversations. These are suggestions only and are not mandatory.

SMS Verification Messages

Find or Be Found uses SMS text messages solely for the purpose of phone number verification during account registration. By providing your phone number and requesting a verification code, you consent to receive a one-time SMS message containing your verification code.

• Program Name: Find or Be Found Phone Verification
• Message Frequency: One-time verification code per request. No recurring messages.
• Message and data rates may apply. Please contact your wireless carrier for details about your messaging plan.
• Opt-Out: You may reply STOP to any verification message to opt out of future SMS messages. If you opt out, you may still verify your account through alternative methods.
• Help: Reply HELP for assistance, or contact us at support@tofindorbefound.com.
• Your phone number is used only for verification purposes and is not shared with third parties for marketing.
• SMS messages are sent via Twilio. By providing your phone number, you acknowledge that your number will be processed by Twilio in accordance with their privacy policy.

Supported carriers include but are not limited to: AT&T, T-Mobile, Verizon, Sprint, and other major US carriers. Service may not be available on all carriers.

9. Bump Mode & Location Services

Bump Mode is an optional feature that uses your device's location services to notify you when you are in proximity to a potential match.

Location Data

• Bump Mode requires access to your device's location services. You may enable or disable this feature at any time.
• Location data is used solely for the purpose of the Bump Mode feature and is handled in accordance with our Privacy Policy.
• We do not share your precise location with other users. Proximity notifications indicate general nearness, not exact coordinates.
• Location data is processed in real-time and is not stored indefinitely.

Safety

• Always prioritize your personal safety when meeting someone in person.
• Meet in public places for initial encounters.
• Inform a trusted friend or family member of your plans.
• We are not responsible for any interactions that occur outside of the Service.

10. Squad Dating & Set Up a Friend

Squad Dating

Squad Dating allows groups of friends to participate in the matching process together. By using Squad Dating, you acknowledge that:

• Other members of your Squad may see your profile and activity within the Squad context.
• Squad interactions are subject to the same conduct standards as individual interactions.
• You are responsible for the invitations you send to join your Squad.
• Squad membership can be managed through your account settings.

Set Up a Friend

The Set Up a Friend feature allows you to create or manage a profile on behalf of a friend with their explicit consent. You agree that:

• You have obtained explicit permission from the person you are setting up before creating or managing their profile.
• All information provided on their behalf is accurate and truthful.
• The person being set up must independently verify and accept these Terms before using the Service.
• You are not responsible for the relationship outcomes of the person you set up.

11. Intellectual Property

The Service and its original content (excluding user-generated content), features, and functionality are owned by Find or Be Found and are protected by international copyright, trademark, patent, trade secret, and other intellectual property laws.

• The "Find or Be Found" name, logo, and all related marks are trademarks of Find or Be Found.
• You may not copy, modify, distribute, sell, or lease any part of the Service or its content without our prior written permission.
• You may not reverse-engineer or attempt to extract the source code of the Service.
• The Grace AI system, matching algorithms, and related technology are proprietary to Find or Be Found.

12. Privacy

Your privacy is important to us. Our collection, use, and sharing of your personal information is governed by our Privacy Policy, which is incorporated into these Terms by reference.

By using the Service, you consent to the collection and use of your information as described in our Privacy Policy. We encourage you to review the Privacy Policy carefully to understand our practices.

13. Disclaimers & Limitation of Liability

Service Provided "As Is"

The Service is provided on an "AS IS" and "AS AVAILABLE" basis without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

No Guarantee of Matches

We do not guarantee that you will find a match, partner, or spouse through the Service. The quality and outcome of your connections depend on many factors beyond our control.

Limitation of Liability

To the maximum extent permitted by applicable law, Find or Be Found and its officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to:

• Loss of profits, data, or goodwill.
• Personal injury or emotional distress arising from your use of the Service.
• Any conduct or content of any third party on the Service.
• Unauthorized access to or alteration of your transmissions or data.
• Any interactions between users, whether online or offline.

In no event shall our total liability to you exceed the amount you have paid to us in the twelve (12) months preceding the claim.

14. Account Termination & Suspension

Termination by You

You may delete your account at any time through the app settings or by contacting us at legal@tofindorbefound.com. Upon deletion:

• Your profile will be removed from the Service.
• Active subscriptions must be canceled separately through your app store.
• Some data may be retained as required by law or for legitimate business purposes, as described in our Privacy Policy.

Termination by Us

We reserve the right to suspend or terminate your account, with or without notice, for any reason, including but not limited to:

• Violation of these Terms or our Community Standards.
• Fraudulent, abusive, or illegal activity.
• Behavior that creates liability or harm to other users or the Service.
• Extended periods of inactivity.
• Requests from law enforcement or government agencies.

15. Dispute Resolution

Informal Resolution

Before filing any formal legal action, you agree to attempt to resolve any dispute informally by contacting us at legal@tofindorbefound.com. We will attempt to resolve the dispute within 30 days.

Binding Arbitration

If an informal resolution is not reached, any dispute, controversy, or claim arising out of or relating to these Terms or the Service shall be settled by binding arbitration in accordance with the rules of the American Arbitration Association. The arbitration shall be conducted in English and the arbitral decision may be enforced in any court of competent jurisdiction.

Class Action Waiver

You agree that any dispute resolution proceedings will be conducted only on an individual basis and not in a class, consolidated, or representative action. You waive any right to participate in a class action lawsuit or class-wide arbitration.

16. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict of law provisions. Any legal action or proceeding not subject to arbitration shall be brought exclusively in the federal or state courts located in Delaware.

17. Changes to Terms

We reserve the right to modify these Terms at any time. When we make material changes, we will:

• Update the "Last Updated" date at the top of these Terms.
• Notify you through the app or via email to the address associated with your account.
• Provide a reasonable period for you to review the changes before they take effect.

Your continued use of the Service after the effective date of any changes constitutes your acceptance of the revised Terms. If you do not agree to the updated Terms, you must stop using the Service and delete your account.
